Terms and Conditions

Please read the following Terms and Conditions carefully as the use of our website and the purchase of products from it, mean you agree to bide by them.

As a UK company all purchases made via this site are subject to current UK retailing law for distance selling- The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 – so you can shop in confidence with us.

Definitions

In this Agreement, unless the context otherwise requires, the following expressions have the following meanings:

‘Supplier’ means Portable Power Technology Ltd whose office is at:

‘Goods’ means the goods or services supplied by Portable Power Technology Ltd
‘Customer’ means the person or company who purchases or agrees to purchase goods or services from Portable Power Technology Ltd

Pricing and availability

The supplier will try its best to maintain the sites prices, details and availability at all times but this cannot be guaranteed. If there is any problem with your order we will try to contact you. If this is the case and the goods have not been dispatched, you can of course cancel your order and we will refund any money you have been charged. You will need to pay a delivery charge on of £6.95 inc. VAT on all orders less than £100.00. If your delivery address is outside Mainland UK such as Scottish Highlands, Channel Islands, Scottish Islands and some other exceptions then you will be charged a shipping rate. This will be clearly indicated during the checkout process.

Payment

Payment for the goods and delivery charges can be made by any method shown on our website at the time you place your order. Payment shall be due before the delivery date. There will be no delivery until cleared funds are received.

Delivery

Orders placed before 3pm on a working day (Monday to Friday excluding public holidays) will be processed that day and will be delivered as per the requested delivery option, provided no additional security checks are required and all items are in stock.

The goods you order will be delivered to the delivery/shipping address given when you place your order.

If delivery cannot be made to your delivery/shipping address for reasons under the Supplier’s control, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.

If you deliberately fail to take delivery of the goods when delivery is attempted, then the Supplier may: store the goods until actual delivery and charge you for reasonable costs of storage; or sell the goods at the best readily obtainable price and (after deducting all reasonable storage and selling expenses) credit to you for any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods.

If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations 2000, the Supplier shall refund or re-credit you within 30 days any sum that has been paid by you or debited from your credit card for the goods less any expenses incurred for failed delivery.

Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delays in delivery.

Time for delivery shall not be of the essence. The goods may be delivered by the Supplier in advance of the quoted delivery date.

Risk/Title

The goods are at your risk from the time of delivery.
Ownership of the goods shall not pass from the Supplier to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of:
the goods, and all other sums which are or which become due to the Supplier from you on any account.

The supplier shall be entitled to recover payment for the goods notwithstanding that ownership of any of the goods has not passed from them.

Returns policy

You can return any item you order, so long as it is returned in its original condition to the address supplied on the delivery note (received with your order) within 14 days of the date of order. The supplier will refund you the cost of the product. You must pay for the return postage of the goods. You will be responsible for return costs unless the item(s) are faulty. In this case contact us and we will advise you of the best method of return. You are responsible for any returned item(s) until they reach us. Please read our returns policy

Data protection

The supplier assures you that, we will not pass any of your details on to any other companies and that your details will be held in a secure and responsible way. By submitting any feedback forms from this website you accept that we can store your details. We do not forward them to any other companies; however we may E-mail you details of special offers, products or news you may be interested in. You can contact us at any time if you wish to have your details removed from our records, or if you wish not to receive any correspondence from us. Please read our privacy policy

Specifications

Every effort has been made to ensure that the specifications in contained in this website are correct, however technical data, dimensions and weights serve as a guide only. Sometimes product specifications may change, in such instances we’ll do our very best to inform you when placing your order. All our sizes and measurements are approximate but we do try to make sure they are as accurate as possible.

Placing orders

The supplier will not be held responsible for any losses resulting from the use of our website or from unauthorized access to, or alteration of your order data in any circumstances, further more we will not be held responsible for any of loss of profits, time or data. If you have placed your order On-line, you will receive an automated email response. Receipt of an automated email does not necessarily mean that we can accept your order or will be able to supply your order.

Limitation of Liability

Subject to iv) below, if you are a consumer the Supplier shall not be liable to you for any loss or damage in circumstances where:
i) there is no breach of a legal duty owed to you by the Supplier or by its employees or agents;
ii) such loss or damage is not a reasonably foreseeable result of any such breach;
iii) any increase in loss or damage resulting from breach by you of any term of this contract.
iv) Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Supplier’s negligence or fraudulent misrepresentation.

If you are a business customer the Supplier shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

Nothing in these Terms and Conditions shall exclude the Suppliers liability for personal injury or death caused by its negligence.
